This Textpro Privacy Policy (“Privacy Policy”) explains how Text Pro, LLC (“Textpro”, “we,” “us,” or “our”) collects, uses and shares information about its customers. This Privacy Policy applies when you visit the Textpro website, textpro.ai, (the “Site”), and/or when you use the Textpro texting service including any written, electronic, and oral communications (collectively the “Service”).

Please read this Privacy Policy carefully. By using the Service, you acknowledge that you have read, understood, and agree to be bound by the terms of this Privacy Policy and consent to Textpro’s collection, use and disclosure of personally identifiable information (“Personal Information”) and other information as set forth herein. If you do not consent to the terms of this Privacy Policy, you should not access or use the Service in any way and should immediately exit the Service.

COLLECTION OF INFORMATION

Personal Information: If you desire to access or use the Service, you may be required to submit certain Personal Information and other information to Textpro including:

Phone number – cellular
Name
Email address
Physical address
Date of birth
Gender

Textpro may maintain a record of your order and purchase history.

Use Data: By choosing to use the Service, you agree to provide Textpro with certain information that is automatically created, collected, and recorded by your use of the Service (“Use Data”). Use Data may include information such as whether you are a new or return user, your mobile device type, browser type, browser plug-ins, certain device settings, device network/carrier, click stream information, geographical location information, and current IP address. Textpro uses third-party website browser software tools (the “Tools”), such as cookies, web beacons, tags or pixels, web server logs, and analysis software (which may include Google Analytics) to gather Use Data. The Tools may be used by Textpro to, among other things, collect business and technical statistics, such as the number of new visitors to the Service and the date and time of visits. Use Data is collected on an aggregate basis.

Textpro may use the following technologies to collect Use Data:

“Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.
“Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Site.
“Web server logs” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
“Google Analytics” is a web analytics service that tracks and reports website traffic including device information such as device type, service provider and operating system, and site usage information such as referring pages and search terms, session duration, and pages visited.

USE OF INFORMATION

The Personal Information we collect is used for various purposes in connection with our business, including, but not limited to:

Provide the services and customer support you request including fulfilling any orders placed through the Service (including processing your payment information, arranging for delivery, and providing you with invoices and/or order confirmations);
Communicate with you, including to notify you about important changes to the Service, to provide you with information related to the Service or that we otherwise believe will be of interest to you, and to answer your inquiries or requests;
Send you email and text communications if you have subscribed to those services;

Textpro uses Use Data in order to monitor use of the Service, for the Service’s technical administration, and to improve the Service. Textpro also uses Use Data to conduct tracking and analytics including customer demographics, for marketing and advertising purposes, and to help us understand how people use the Service.

EMAILS

If you provide us with your email address, you authorize us to send you regular emails unless and until you request to unsubscribe from such emails. These emails may include information about changes to the Service. Each email we send contains an easy, automated way for you to unsubscribe from further emails from us. Select the "unsubscribe" link in the footer of an email from us and follow the directions to communicate your preferences to us.

TEXT MESSAGES

Textpro uses text messages to communicate with you including to fulfill your requests for goods and services. We may send you marketing text messages that you have consented to receive. You can cancel text messages at any time by texting "STOP". However, if you cancel text messages, we will no longer be able to provide you with our services. After you send "STOP", we may send you an additional text message to confirm that you have been unsubscribed. After receiving the unsubscribe confirmation, you will no longer receive text messages from that text list, but you may still receive text messages from our other text lists if you have subscribed to them. If at any time you have questions about the text messages, text "HELP". After you send "HELP" we will respond with instructions on how to use our service as well as how to unsubscribe. Message and data rates may apply.

DO NOT TRACK

Please note that Textpro does not alter our data collection and use practices when we see a Do Not Track signal from your browser.

SHARING OF INFORMATION

We work with a number of business partners in order to provide you the Service. These business partners may include but are not limited to online retailers, travel-related suppliers, ticket agencies, activity providers, delivery businesses, and food establishments. In order to fulfill your requests and provide you with products and services, we may share your Personal Information with our business partners. When you provide Personal Information in connection with ordering goods and/or services, you are providing such Personal Information to those business partners. Our business partners use the information we give them as described in their privacy policies which may include sharing your information, including Personal Information, with others, and sending you marketing communications. You should read those polices to learn how they treat your information.

Service Providers: We engage certain trusted third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance, customer relations and support, database storage and management, data analysis, payment processing, fraud prevention, and legal, accounting, and marketing services. We may share your Personal Information or Use Data with these third parties, but only to the extent necessary to perform these functions and provide such services.

Other Third Parties: We also may share, disclose, or transfer your Personal Information or Use Data with third parties as follows: (a) to government agencies, advisors and other third parties, where necessary and appropriate, in order to comply with applicable laws, the service of legal process, or if we reasonably believe that such action is necessary to (i) comply with the law requiring such disclosure, (ii) protect Textpro’s rights or property, (iii) prevent a crime or protect national security or (iv) protect the personal safety of the users or the public; or (b) if we believe your actions violate our Terms of Service or other policies; or (c) in connection with a financing or a sale, acquisition, or merger of our business or our business assets. We may share your information for reasons not described in this policy. We will notify you before we do this.

THIRD PARTY SITES

The Service may contain links to external websites. Please note that this Privacy Policy does not apply to third-party websites to which the Service links. Textpro is not responsible for the practices or policies (including privacy policies) employed by the third-party websites linked to or from the Service nor the information or content contained therein. You should review the privacy practices and policies of such third parties prior to providing your Personal Information in connection with such websites.

VISITORS FROM OUTSIDE THE U.S.

The Service is maintained in the United States. This Privacy Policy governs the information collected at by the Service regardless of where you're located when you access it, browse it or interact with it. This means your Personal Information may be stored outside of the province, state, and/or country in which you reside, and may be processed by us, an affiliate or a third-party service provider as described in this Privacy Policy. You freely and specifically consent to such transfer of your Personal Information outside of your state and country of residence. Moreover, governmental bodies that have jurisdiction (e.g., courts and law enforcement agencies) may be entitled to access your Personal Information.

ACCESSING YOUR PERSONAL INFORMATION

When you sign up for a plan, Textpro will begin logging your order history for purposes of reordering, which you will see when you reorder from a restaurant or grocer. To update your address at any time, just text "address" and your delivery location and search radius (for sports/concert tickets) will be automatically updated.

SECURITY

Textpro uses reasonable care to protect the privacy and security of Personal Information and to ensure that our systems are secure and meet industry standards. Where appropriate, we employ firewalls, encryption technology, and user authentication systems (e.g., usernames and passwords) to control access to systems and data. Unfortunately, no Internet transmission is ever completely secure, and we cannot guarantee that unauthorized access, hacking, data loss or other breaches will never occur. WE EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO ANY BREACHES OF SECURITY, DAMAGE TO YOUR DEVICE, OR ANY LOSS OR UNAUTHORIZED USE OF YOUR PERSONAL INFORMATION OR OTHER DATA.

UNAUTHORIZED USE

Unauthorized attempts to use the Service in a way that violates our Terms of Service, to utilize the Service for other than its intended purposes, or to defeat or circumvent the Service’s security features are strictly prohibited. We do not intend for the Service to be used by children under the age of 18, nor do we seek to collect information about children under the age of 18. If you are under the age of 18, please do not provide us any information and promptly exit the Service.

Textpro may amend, update or modify the terms of this Privacy Policy at any time, by posting an amended Privacy Policy on the Site. If you do not consent to the terms of this Privacy Policy, as amended, you should not access or use the Service in any way and should immediately exit the Service. By continuing to access or use the Service after those changes become effective, you agree to be bound by the revised Privacy Policy.
